A California judge ruled Thursday that Samsung can no longer sell its Galaxy Tab 10.1 in the US, based on Apple?s claims that Samsung violated its iPad patents.

In the meantime, the US District Court of the Northern District of California will continue to inspect Apple?s patents and compare them to Samsung?s products, according to the Associated Press.?

So far, the Tab?s future doesn?t look promising ? presiding Judge Lucy Koh said Apple ?has established a strong case on the merits,? deeming the iPad and the Galaxy Tab 10.1 ?virtually indistinguishable.?

Indeed, the latest iPad and the Samsung Galaxy Tab 10.1 boast similar sleek industrial designs and functionalities. Both have been built to serve as work- and entertainment-friendly helpers as well as laptop rivals, and it doesn?t help that they?re almost the exact same shape and size (the iPad has a 9.7-inch screen, while the Galaxy Tab?s comes out at 10.1 inches).

Apple argues that ?the design and appearance of Samsung?s forthcoming products and packaging are directly relevant to Apple?s trademark, trade dress, and design claims,? court documents say.

By comparison, tablets like the Kindle Fire and the Nexus 7, which both cost $199, still tend to fall under the eReaders category. The iPad and the Galaxy Tab start at $499.

Judge Koh ordered Apple to post a $2,600,000 bond ?to secure payment of any damages sustained by defendant if it is later found to have been wrongfully enjoined.?

The two technology giants have been battling it out since April 2011, when Apple filed a suit alleging that ?Samsung?s Galaxy cell phones and computer tablets infringe Apple?s trade dress, trademarks, and design patents.?

With the release of Samsung?s Galaxy S III ? which some say is also similar to Apple?s slim iPhone 4S ? the war doesn?t look like it?ll be over anytime soon.

Denon AVR-1613

Even just a few years ago, many home theater receivers required optional iPod docks that were clumsy to set up and featured primitive on-screen user interfaces. The Denon AVR-1613 ($399.99 direct) has baked-in iPod and AirPlay capability, and sits squarely in the mainstream end of Denon's lineup. It's a solid receiver and a good buy as an up-to-date centerpiece to a home theater system, even though it clearly shows signs of its 1990s-era roots.

Design, Inputs, and Features
Measuring 5.9 by 17.1 by 13.0 inches (HWD), the The AVR-1613 weighs just over 18 pounds. A front-panel USB input makes it easy to pop in a thumb drive, or access the stored contents on an iOS device while charging it simultaneously. The power cord is hardwired, which is unfortunate if it fails down the road, but it's not a big issue for a lower-priced receiver. In standby mode, Denon claims the AVR-1613 draws just one tenth of a watt.

There are five HDMI inputs?one more than the Yamaha RX-V473 ($449.99, 3.5 stars)?including a convenient port on the front, which is great for plugging in a smartphone, tablet, or laptop computer. All of the HDMI inputs support video switching, so you won't have to use two remote controls to watch different sources. There are no component or S-video inputs and outputs, though. All you get besides HDMI are two sets of composite inputs and one set of outputs, although at this point that's less of a problem than it would have been, say, two years ago. If you need these connectors, the RX-V473 is a better choice.?

AirPlay support is a recent addition. It lets you stream music over the air wirelessly from an iPhone, iPod, iPad, Apple TV, or even a computer running iTunes. Unfortunately, the AVR-1613 itself does not integrate Wi-Fi. To use AirPlay, you need to connect the receiver to your home network via a wired Ethernet connection. Pandora and Sirius XM streaming, as well as access to Denon's own radio site, which delivers more than 12,000 Internet radio stations, are all onboard.

The AVR-1613 is also DNLA 1.5 certified, but there's no HD Radio or even AM tuner?your only terrestrial option is FM stereo. I would have liked to see stereo Bluetooth support, especially now that Android handsets dominate smartphone sales by a significant margin. On the plus side, you'll still get better sound quality via the phone's headphone output?using an inexpensive Y-cable available at Radio Shack, as the AVR-1613 lacks a front-mounted stereo mini-jack.

The included remote control is much simpler than the one Yamaha bundles with the RX-V473. Unfortunately, it was rather stubborn in my tests. Sometimes the AVR-1613 just didn't respond to my commands, as if it were stuck thinking about the last thing I asked for.?In addition to the remote, the receiver comes with an Audyssey setup microphone for speaker calibration, a Getting Started guide, and an owner's manual in PDF format on a CD. Denon also, inexplicably, throws in a copy of Nero 9 Essentials.

Setup, Calibration, and Amplification
To get started, you'll need an HDMI cable, a set of passive speakers (either stereo or 5.1), and a TV, which you'll need for setting up the receiver and accessing the iPod interface as well as for watching movies.

On first bootup, the AVR-1613 will walk you through an on-screen setup wizard using the remote control. It asks whether you have a center channel, surround speakers, or a subwoofer. Then it offers to measure the acoustics of your room using the included microphone and a series of sound tests. You plug the setup microphone into the Setup Mic port on the front panel. From there, the system walks you through setting up your input devices (such as a Blu-ray player or Xbox 360), and then prompts you to connect to a wired network.

As a proper home theater receiver, the AVR-1613 includes five discrete channels of amplification, with each outputting 75 watts at 0.08 percent THD. Audiophiles still prefer separate preamps and amplifiers, but Denon receivers have always acquitted themselves well in terms of sound quality.

Fortunately, the Denon AVR-1613 simply sounds great?anyone concerned about the actual output will be more than pleased with this receiver. I tested the AVR-1613 with a set of Energy Take Classic 5.1 ($399, 4 stars) speakers, which includes five two-way satellites and a 200-watt, 8-inch powered subwoofer. Through the satellites, I heard clean, powerful sound at full tilt, with smooth, transparent highs and a clearly defined, three-dimensional image. The Take Classic 5.1 satellites offer 89 dB sensitivity, which isn't the most efficient design out there. But even so, the AVR-1613 had no trouble driving these to ear-splitting volumes.

To test the Denon AVR-1613's home theater prowess, I ran scenes from the the 2010 DTS Demonstration Blu-Ray Disc through the receiver, a Samsung BD-D5500 ($159.99, 3.5 stars) Blu-ray player, a Sony Bravia KDL-46EX620 ($809.99, 3.5 stars), and?the Energy Take Classic 5.1 speakers. Generally speaking, the Denon handled the job with aplomb; it sounded slightly warmer than the Yamaha RX-V473, with less treble emphasis and a slightly more full-bodied lower midrange. Even so, voices, arrow shots, and horse gallops sounded clear and distinct in Robin Hood (the 2010 film with Russell Crowe), and the Take Classic 5.1 had no problem rendering many sound sources simultaneously throughout the image. With the DTS-encoded Despicable Me, the AVR-1613 clearly separtated the rocket ship engines and low rumble while in flight, and put up clear dialog throughout.

iPod Playback and UI Issues
The AVR-1613's digital music chops need work. I plugged my iPhone into the front-mounted USB port and switched the Denon's source to iPod/USB. (Unfortunately, it doesn't work with iPads in this mode.) You can play stored iPod music two ways: In Remote Mode, which lets you control playback directly from the iPod, and Browse Mode, which puts up track and artist info on the screen, and lets you select it using the Denon's remote control. I tested the iPod playback with two devices: the aforementioned iPhone, and a 4th-generation iPod nano. Both worked, although the AVR-1613 was temperamental. Sometimes it played music back fine; other times, it remained stuck at the beginning of the song.

A firmware update became available toward the end of the review period, which promised to take 21 minutes to install. Excited by the prospect of eliminating the bugs, I installed it?only to see that the on-screen menu text, already buggy, pixelated, and slightly wobbly, became downright unreadable on the music playback screen. Everything looked doubled; rebooting the monitor and the receiver didn't help. Worse, iPod playback was buggier than before. Once, it started a song at full blast, threatening to deafen me and blow out the speaker system. It wouldn't respond to the volume dial, and wouldn't even shut off with the power switch; I had to hold it down for five seconds to get the receiver to power down. (Next up would have been pulling the plug.) It didn't do this again, but the intermittent playback issues continued.

AirPlay and Conclusions
On the plus side, AirPlay connectivity worked great. Once I configured the unit over wired Ethernet, I had no problem streaming music from various AirPlay-compatible devices to the AVR-1613. The receiver displays album art on screen whenever available, which is something the Yamaha RX-V473 doesn't do. Pandora playback also worked well; I logged in with my account, started several of my stations, and listened to uninterrupted streaming Internet radio.

I also tested Denon's free iOS remote control app, which works with the AVR-1613 and other networked receivers from the company. It does the job, but it has a very confusing UI?it took plenty of tapping and head-scratching to figure out where everything was. Yamaha's free iOS app is much more thoughtfully designed, although actual functionality differences between the two are less than they appear once you figure out where Denon hid the source select, DSP modes, and other playback and setup controls.

All told, the Denon AVR-1613 makes a solid centerpiece to a proper home theater system in 2012. But thanks to its lack of Wi-Fi and its rudimentary display graphics, there's a bit of a disconnect between 1980s and 1990s-style home theater components, and the complex, fragmented world that is music listening today. So while the AVR-1613 could use more refinement, it's impressively well specified otherwise, and should let you do just about anything you'd want with a home theater setup today.

NEW YORK (June 28, 2012) ? NHL referee Marcus Vinnerborg announced his retirement today, explaining that he and his family have decided to move back to their native country of Sweden.

?Two years ago I was given the opportunity by the NHL to live my dream of officiating professional hockey in North America. My family supported me and thoroughly enjoyed their experience living here,? said Vinnerborg. ?It was a difficult choice, but we have decided as a family to move back to Sweden. I would like to thank Terry Gregson and the NHL for the incredible experience. I return to Europe a more educated official having had the opportunity to work with all of my colleagues and supervisors at the NHL.?

The first European-trained NHL official, Vinnerborg?s premier assignment saw the Dallas Stars play host to the Anaheim Ducks at American Airlines Center on Nov. 16, 2010. He refereed 40 total NHL games, calling his final contest on April 1, 2012, when the Ducks faced the Edmonton Oilers at Honda Center.

?I?d like to thank Marcus for his service and willingness to come to North America,? said Terry Gregson, NHL Senior Vice President and Director of Officiating. ?We wish him and his family the best as they return to Sweden.?

Google's Nexus 7 cover turns up on the Play store, will set you back $20

Not surprisingly, Google will have some accessories for its new Nexus 7 tablet, including a cover that also leaked out a bit early though Google Play (and spotted by MoDaCo's Paul O'Brien). As you can see, it will cover both the front and back of the device, and set you back a reasonable $20. Available at least in dark grey, it has a matte (seemingly textured) finish, and provides to both the tablet's headphone jacket and charging port.

1. Ask For House Flipping Success

The first step is to ask, make a command to the universe - let the universe know what it is that you want.

Write it out on a piece of paper in very clear and explicit language. Make sure you write it in the present. You can start by saying" "I am so grateful that the universe has enabled me to make $135,000 per year investing in real estate". You must be very specific as to what it is that you want or the universe will work against you to not bring you what it is that you want. After all, if you were ordering something from a catalog or on Amazon, you wouldn't keep placing the order multiple times until it's delivered to you would you? All you have to do is just place your order. Once you've done this, you can kick back and roll ask because what you have ordered will now come to you.

2. Behave as if you already received what you've ordered

The next step is quite simple: just believe that what you've ordered has already arrived. You need to believe that what you really want has already come, you must have complete and utter faith that it will arrive.

When you place an order in the L.L. Bean catalog, you know that the delivery truck will bring whatever it is that you've ordered to you. All you need to do is wait. It's no different from asking for success in flipping houses. Simply believe what you have asked for has already arrived in your life and you are now enjoying the benefits. The minute you ask for your order the universe then rearranges itself to bring it to you.

3: Start to receive real estate investing success

Begin to feel incredible about it that you want. Feel the way you will feel once it arrives. Envision yourself proudly telling your spouse, your friends your family how successful you become flipping houses. See the success as you visualize it in your mind.

Don't think about how it will come to you.When you think about how it will come to you, it creates doubt in your mind.Your job is not "the how". The "how will I achieve success flipping houses" is not your part in the creative process.

This model? encompasses five measurable elements that constitute human flourishing: positive emotions, engagement, positive relationships, meaning and accomplishment.

Jenna Jameson Charged in DUI Case

Jenna Jameson has officially been charged with DUI, having allegedly been using drugs and alcohol when she smashed her car into a pole last month.

Jameson was arrested after the single-car accident early May 25.

Small business owners will be watching when the Supreme Court issues its ruling on the constitutionality of the Patient Protection and Affordable Care Act. The overhaul of the nation?s health care system requires that by 2014, all businesses with more than 50 employees must provide health care benefits that are deemed affordable under the law.

Opponents of the act have targeted a key provision known as the individual mandate. It requires all people to buy health insurance or pay a penalty. The rationale for the mandate is that the more people in the health insurance pool ? in particular, younger and healthier people who need little health care ? the cheaper care will be for everyone. Opponents of the individual mandate contend that it?s unconstitutional to require people to buy health insurance. The court has the power to uphold the law or rule all or part of it unconstitutional.

With a decision expected in the coming days, here are some questions and answers about how this affects small business owners:

Q. What will owners have to do if the law is upheld in its entirety?

A. Employers will be subject to the law if they have 50 or more full-time workers or the equivalent of full-time workers (two people working half-time are the equivalent of one full-timer). Small businesses that don?t comply with the law ? either by not offering insurance or by offering insurance that?s not considered affordable ? will have to pay penalties. To be considered affordable, the insurance must pay for at least 60 percent of covered health care expenses, and employees may not be forced to pay more than 9.5 percent of their family income (before deductions and adjustments) for coverage offered by employers. Penalties are set according to a complicated formula in the law; they start at $2,000 per worker when there is no coverage, with the first 30 workers excluded from the calculation. Companies also face penalties if they provide coverage that isn?t deemed affordable.

Employers get a tax deduction for providing insurance, but some business owners may decide it?s cheaper to skip the insurance and pay the penalty, says Paul Keckley, executive director of the Deloitte Center for Health Solutions. Deloitte is a consulting and financial advisory firm.

?You can lose the tax deduction, pay the penalty and be better off,? Keckley says. But he also points out that the penalties are scheduled to rise over time, and so eventually employers are likely to comply with the law.

The law also requires small businesses to provide what?s called an essential health benefits package. The states are permitted to determine what benefits should be contained in policies that are issued in their states. That means that businesses that have employees in more than one state will have to comply with each state?s requirements.

Employers can buy insurance from health insurers. Others may opt to join companies known as professional employer organizations like Insperity or ADP?s TotalSource division that provide health insurance and other human resources services. The law creates what are being call health insurance exchanges ? markets where employers and individuals can search for the best rates. John Arensmeyer, CEO of the Small Business Majority, an organization that lobbies on behalf of small businesses, says the exchanges essentially give small businesses negotiating power on insurance rates that they haven?t had in the past.

Q. How many small business owners does this affect?

A. Relatively few. The Census Bureau doesn?t report the number of businesses with more than 50 employees. But it counted 616,693 companies with 20 to 99 employees in 2008, the most recent figures available. That was about 10 percent of the 5.91 million small businesses (those with fewer than 500 employees) the agency counted. Since those figures include companies too small to be covered by the Affordable Care Act, the number of small businesses subject to the law is likely to be much lower. The National Federation of Independent Business, the largest U.S. small business advocacy group says on its website that its typical member employs five people, but notes that it has ?thousands? of members with more than 100 workers. The NFIB argued against the law before the Supreme Court in March. The group?s membership includes about 350,000 small business owners.

Q. Are there advantages for small businesses to the Affordable Care Act?

A. The act limits how much premiums can go up each year, Keckley says. But it?s widely predicted that if the individual mandate is struck down, premiums will rise because fewer people would be buying insurance than they would if the mandate stands.

Some companies? premiums may drop under the law compared with what they?re paying now. The law eliminates the surcharges that insurers impose on companies who have patients with serious medical conditions. ?It gives small businesses peace of mind. They won?t see their premiums rise significantly if one person gets sick,? says Larry Levitt, a senior vice president at the Kaiser Family Foundation, which studies health care policy.

The exchanges are expected to offer small businesses lower rates than insurance companies charge. Businesses will also get tax credits for six years for providing coverage.

Q. What happens to small businesses? costs if the entire law is thrown out?

A. ?It?s essentially back to the way things used to be,? before the law was passed in 2010, Levitt says.

ANKARA, Turkey (AP) ? NATO will hold emergency talks on Tuesday to discuss Syria's downing of a Turkish jet fighter, but the alliance is not expected to take military action, even if it confirms Turkey's claim that the unarmed plane was attacked in international airspace.

The incident has further raised regional tensions over the conflict in Syria, where some 40 people were reported killed Sunday in new clashes between rebels and government troops.

On Sunday, U.S. Secretary of State Hillary Rodham Clinton sharply criticized Syria for downing the Turkish plane, which Turkey's Foreign Ministry called an "open and grave violation of international law" that would justify retaliation.

"The United States condemns this brazen and unacceptable act in the strongest possible terms," Clinton said in Washington. "It is yet another reflection of the Syrian authorities' callous disregard for international norms, human life, and peace and security."

Clinton said Washington will maintain close contact with Turkish officials as they determine their response, including via the U.N. Security Council. "We will work with Turkey and other partners to hold the Assad regime accountable," she said.

Turkish state media reported Sunday that the RF-4E reconnaissance plane's wreckage was found in the Mediterranean Sea at a depth of 4,265 feet (1,300 meters), but officials did not confirm the report. The two pilots remained missing.

Turkish Foreign Minister Ahmet Davutoglu said the jet was on a training flight to test Turkey's radar capabilities, not spying on Syria. He said the plane mistakenly strayed into Syrian airspace Friday, but was quickly warned to leave by Turkish authorities and was a mile (1.6 kms) inside international airspace when it was shot down.

Syria insisted Saturday that the shooting was "not an attack" and that the aircraft had violated its airspace. But Turkish authorities say Syria didn't warn the Turkish plane or send its own jets to confront it.

At the request of Turkey, NATO's governing body will meet Tuesday to discuss the incident, said Oana Lungescu, a NATO spokeswoman. The consultations were called under article 4 of NATO's founding Washington Treaty.

"Under article 4, any ally can request consultations whenever, in the opinion of any of them, their territorial integrity, political independence or security is threatened," Lungescu said. The North Atlantic Council ? the ambassadors of the 28 NATO countries ? will decide whether to respond, she said.

The last time article 4 was invoked was nine years ago ? also by Turkey ? after tensions with neighboring Iraq escalated. However, that case did not lead to the invocation of article 5, which declares that an attack against any single NATO country shall be considered as an attack against them all.

"No one should dare to test Turkey's capabilities," Davutoglu said Sunday.

Turkish Prime Minister Recep Tayyip Erdogan was expected to make a statement Tuesday and might announce some retaliatory steps.

In a telephone interview with Turkish TV news channel A Haber on Saturday, Syrian Foreign Ministry spokesman Jihad Makdissi said the downing was "not an attack.""An unidentified object entered our air space and unfortunately as a result it was brought down. It was understood only later that it was a Turkish plane," A Haber quoted Makdissi as saying. "There was no hostile act against Turkey whatsoever. It was just an act of defense for our sovereignty."

Despite some opposition leaders' calls for Western military intervention in Syria, the U.S. and allies have been hesitant to get involved in what could prove a protracted conflict, preferring the diplomatic route. Syrian allies Russia and China have shielded Syria from U.N. sanctions and stridently oppose any military intervention.

It's unlikely the downing of the Turkish plane will change those calculations, despite Ankara's appeal for the NATO meeting.

In October 1989, two Syrian MiG-21s violated Turkish air space and shot down a Turkish plane on a geographical survey mission, killing all five crew members. Syria at the time promised to severely punish the pilots, who disregarded Turkish orders not to enter Turkish airspace.

Dogu Ergil, a professor of political science at the Ankara University, told private NTV television that Turkey had repeatedly sent its jets across the Syrian border for several weeks to show its military muscle at the time.

The plane's downing drew criticism from other countries pushing Syrian President Bashar Assad to end his crack down on an increasingly armed popular uprising. Opposition activists say the conflict has killed 14,000 people, mostly civilians, over the past 15 months.

British Foreign Secretary William Hague said Sunday he was "gravely concerned by the Syrian regime's action in shooting down" the plane.

"This outrageous act underlines how far beyond accepted behavior the Syrian regime has put itself, and I condemn it wholeheartedly," Hague said in a statement. "The Assad regime should not make the mistake of believing that it can act with impunity. It will be held to account for its behavior."

Hague met last week with U.N. and Arab League special envoy Kofi Annan for talks on plans for an international summit, while British officials discussed the issue in Geneva on Saturday with members of Annan's team. Hague noted Sunday that "the UK stands ready to pursue robust action at the United Nations Security Council."

Italy's foreign minister decried the shooting down of the plane as "a further, very grave and unacceptable action by the Assad regime." In a written statement, Giulio Terzi promised that Italy will play an active role in the NATO meeting Tuesday.

Syrian activists reported violence in different parts of the country Sunday, saying nearly 40 people were killed.

The deadliest incident was in the northern town of Ariha, where a shell hit a home killing seven members of the same family, the Britain-based Syrian Observatory for Human Rights said.? A video posted online showed the seven men's bodies, some badly mutilated, including one who had part of his head blown off.

Activists also reported intense shelling and clashes between rebels and troops in the eastern city of Deir el-Zour and the central city of Homs. Later in the day, Syria's state-run news agency SANA said gunmen kidnapped a pro-government Sunni cleric in the city of Deir el-Zour.

Earlier Sunday, activists said rebels captured a military base in the northern Syrian province of Aleppo, confiscating large amounts of ammunition. The Observatory said 16 government troops died in the attacks on the base near the rebel-held town of Daret Azzeh and nearby checkpoints early Sunday.

Area activist Mohammed Saeed said the rebels had removed hundreds of artillery shells from the base. Saeed added via Skype that troops retaliated with intense shelling on the area using helicopter gunships.

Syria's state-run SANA news agency, meanwhile, said gunmen from Turkey clashed with Syrian border guards in Rabiah, a region in the coastal Latakia province. SANA said several infiltrators died in the late Saturday clash, while others reportedly returned to Turkey. It said several Syrian border guards were hurt, but didn't specify how many.

Turkey denies sheltering armed Syrian rebels, although many Syrian refugees have fled to camps on the Turkish side of the border.
